EcoVac Solutions Ltd. (EcoVac or the “Company”) operates a hydrovac slurry treatment facility located at 58&60A Baywood Road, Etobicoke, Ontario M9V 3Z3.  The process involves receiving hydrovac trucks at one of four receiving bays and tipping the container to allow for the disposal of the slurry material.  The Customer’s personnel are responsible for the operation of their equipment during the disposal process and are required to abide by the Company’s operating procedures including its health and safety policies.  EcoVac’s operating policies are communicated by the EcoVac staff prior to using the facility.

The Customer acknowledges that use of the EcoVac facility is at the Customer’s own risk.  The Customer is responsible for any damage to its property and assumes all liability in relation to the use of the facility including but not limited to liability for bodily injury or loss incurred or sustained by it, its employees or subcontractors while at the EcoVac facility except if caused by EcoVac’s gross negligence.  The Customer will be held responsible for damage to the EcoVac facility if caused by the negligence of the Customer or its personnel.  The Customer is responsible for maintaining commercial general liability insurance and WSIB coverage for its employees.

EcoVac, by providing this liability waiver and by the customers continued use of the EcoVac facility, hereby accept the terms of use of the EcoVac facility and hereby waives any claim for damages in relation to the use of EcoVac’s facility except in cases where such damage is caused by the gross negligence of the Company.
